WAIVER & RELEASE

I represent that I am the Minor's natural guardian and have authority to execute this Agreement on the Minor's behalf. I authorize the Minor to participate in tennis, racquet sports, instruction, clinics, camps, leagues, tournaments, fitness, wellness and other recreational activities offered or permitted at Luna.

On behalf of myself and the Minor, and to the fullest extent permitted by Florida law, I release and waive claims against C&C 97 LLC DBA Luna Racquet & Wellness Club and its owners, affiliates, employees and agents (Released Parties) for personal injury, including death, or property damage resulting from inherent risks of the Minor's activity.

ASSUMPTION OF INHERENT RISKS

I understand that sports and physical activity involve inherent risks, known or unknown, that are characteristic of, intrinsic to, or an integral part of the activity and cannot be eliminated even when reasonable care is used. These may include falls; collisions; contact with balls, racquets, equipment or other participants; physical exertion; bodily injury; weather; wet or changing surfaces; and negligent or intentional conduct of another participant. I voluntarily assume these inherent risks on behalf of the Minor to the extent permitted by Florida law.

HAR-TRU / SOFT COURT SURFACE ACKNOWLEDGMENT

I understand that Luna's Har-Tru tennis courts are soft-surface courts. Unlike a fixed hard-court surface, a Har-Tru surface naturally changes in shape, firmness, moisture, compaction and level as a result of normal play, weather, irrigation and routine maintenance. The playing surface may contain variations, including areas that are uneven, loose, soft, firm, damp, dry, worn or displaced. I accept these natural and changing characteristics as part of participation on a Har-Tru court.

MEDICAL AUTHORIZATION

If the Minor becomes ill or injured while participating at Luna, I authorize Luna or its designee, when reasonably necessary, to contact emergency services and provide or arrange first aid or other emergency assistance deemed appropriate. Luna has the right, but not the obligation, to provide or arrange such assistance. I accept responsibility for costs incurred on the Minor's behalf.

FLORIDA STATUTORY NOTICE

NOTICE TO THE MINOR CHILD'S NATURAL GUARDIAN

READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY.

YOU ARE AGREEING THAT, EVEN IF C&C 97 LLC DBA LUNA RACQUET & WELLNESS CLUB, ITS OWNERS, AFFILIATES, EMPLOYEES, OR AGENTS USES REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY.

THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED.

BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD'S RIGHT AND YOUR RIGHT TO RECOVER FROM C&C 97 LLC DBA LUNA RACQUET & WELLNESS CLUB, ITS OWNERS, AFFILIATES, EMPLOYEES, OR AGENTS IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY.

YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND C&C 97 LLC DBA LUNA RACQUET & WELLNESS CLUB, ITS OWNERS, AFFILIATES, EMPLOYEES, OR AGENTS HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM.

PARENT / NATURAL GUARDIAN ACKNOWLEDGMENT

I have read and understand this Agreement and the statutory notice above. I voluntarily authorize the Minor to participate at Luna and agree, individually and on behalf of the Minor, to the waivers, releases, assumptions of inherent risk and authorizations contained in this Agreement to the extent permitted by Florida law.

This Agreement remains effective for twelve (12) months from the date of acceptance and applies to the Minor's covered activities during that period. Luna may require a new or updated agreement at any time.
